TMSU – By Election updates and unofficial results

Hello TMSU Members,

This communication is to formally advise the community of the Elections & Referenda Committee’s decision regarding the Fall 2025 Executive and Director Elections and the next steps moving forward.

Earlier this afternoon the Elections and Referendum Committee released the final appeal that was pending for the 2025 Fall By-election. The ERC’s ruling, which is available on TMSU’s elections website, upholds the Chief Returning Officer’s prior decision that the Executive Election of the 2025 By-election is null and void.

The Executive Election was ruled null and void due to the extraordinary number of complaints and overwhelming evidence of widespread improper interference with Members’ votes in relation to the Executive candidates.

The rulings setting out the evidence and reasoning for this conclusion are:

Ruling #2025FBE028 is also relevant to the overall fairness of the Executive vote.

As a result of these rulings, and in light of the time that would be required to convene a new Executive vote, the ERC has further decided that TMSU will not be redoing the By-election vote. Instead, a new Executive will be elected via the upcoming General Election. The nomination period for the General Election will begin in three weeks, on February 12, 2026.  

The full schedule for the General Election is set out below. 

While the Executive Election has been deemed null and void, the Director Elections were not impacted by this decision.

The ERC carefully considered whether the widespread misconduct that led to the nullification of the Executive vote also undermined the fairness and integrity of the vote for the Faculty Director positions. The vast majority of the evidence and substantiated complaints, however, demonstrated impermissible vote solicitation for Executive positions. There was not a similar level of allegations or evidence regarding impermissible vote solicitation for Director positions. The ERC therefore decided that the nullification of the election should only extend to the Executive positions.
